1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of services provided by RCS Infotax ("we," "us," or "our"), including but not limited to GST registration, company registration, MSME registration, GST return filing, income tax return filing, and any related services (collectively, the "Services").
By accessing, using, or purchasing our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.
Important: If you do not agree to these Terms, you must not access or use our Services. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting on our website.
2. Our Services
RCS Infotax provides professional consultancy and facilitation services for various regulatory and compliance matters. Our services include:
2.1 Service Scope
- GST Registration: Assistance in obtaining Goods and Services Tax registration from the appropriate authorities.
- Company Registration: Facilitation of private limited company, LLP, OPC, and other business entity registrations.
- MSME Registration: Assistance in obtaining MSME/Udyam registration and related benefits.
- GST Return Filing: Preparation and filing of various GST returns including GSTR-1, GSTR-3B, and annual returns.
- Income Tax Return Filing: Preparation and filing of income tax returns for individuals, companies, and other entities.
- Related Advisory Services: Consultancy on tax matters, compliance requirements, and regulatory changes.
2.2 Service Limitations
We act as facilitators and consultants. We do not provide legal advice unless explicitly stated and performed by a qualified legal professional. Our services are subject to:
- Timely provision of complete and accurate information by the client
- Government processing timelines and requirements
- Technical feasibility and regulatory constraints
- Payment of all applicable government fees and charges
3. Eligibility
To use our Services, you must:
- Be at least 18 years of age or the age of majority in your jurisdiction
- Have the legal capacity to enter into binding contracts
- Provide accurate, current, and complete information during registration
- Maintain the confidentiality of your account credentials
- Comply with all applicable laws and regulations
We reserve the right to refuse service to anyone for any reason at any time, including but not limited to suspicion of fraudulent activity, violation of these Terms, or failure to provide required information.
4. User Responsibilities
As a user of our Services, you agree to:
4.1 Information Accuracy
You are solely responsible for providing accurate, complete, and up-to-date information required for our services. We are not liable for any consequences arising from incorrect, incomplete, or outdated information provided by you.
4.2 Document Verification
You must review all documents prepared by us before submission to authorities. While we strive for accuracy, final verification of all documents is your responsibility.
4.3 Timely Cooperation
You agree to provide necessary documents, information, and approvals in a timely manner to ensure smooth processing of your applications.
4.4 Compliance with Laws
You are responsible for complying with all applicable laws, rules, and regulations related to your business activities and filings.
5. Fees and Payment
5.1 Service Fees
Our fees are as quoted at the time of service engagement and may include:
- Professional service charges
- Government fees and taxes
- Any additional charges for expedited services
5.2 Payment Terms
Unless otherwise agreed in writing:
- 50% advance payment is required to initiate services
- Balance payment is due upon completion of services
- All payments are non-refundable once services have commenced
- Late payments may attract interest charges of 1.5% per month
5.3 Government Fees
Government fees and charges are separate from our service fees and must be paid as required by the respective authorities. We are not responsible for changes in government fees.
Note: All fees are subject to change without prior notice. Current applicable taxes will be added to all invoices.
6. Confidentiality
We maintain strict confidentiality regarding all client information. However, you acknowledge and agree that:
- We may share information with government authorities as required for service delivery
- We may use aggregated, anonymized data for statistical purposes
- We may disclose information if required by law or legal process
- Our confidentiality obligations do not apply to information that is publicly available or independently developed
7. Liability & Limitations
7.1 Limitation of Liability
To the maximum extent permitted by law, RCS Infotax shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or use
- Delays caused by government authorities, technical issues, or force majeure events
- Errors or omissions in information provided by you
7.2 Maximum Liability
Our total liability for any claim arising from these Terms or our Services shall not exceed the total fees paid by you for the specific service giving rise to the claim.
7.3 Indemnification
You agree to indemnify and hold harmless RCS Infotax, its directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your breach of these Terms
- Your violation of any law or third-party rights
- Your use of our Services
8. Termination
Either party may terminate the service agreement:

9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
Any disputes arising from these Terms or our Services shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
Dispute Resolution: We encourage you to contact us first to resolve any disputes amicably. If unable to resolve, the matter shall be referred to mediation before pursuing legal action.
10. Changes to Terms
We reserve the right to modify or replace these Terms at any time. The updated version will be indicated by an updated "Last Updated" date at the top of this page.
Your continued use of our Services after any changes constitutes acceptance of the modified Terms. We will make reasonable efforts to notify you of material changes via email or website notice.
